One investment can include the family
A qualifying EB‑5 investment can generally include the principal investor, a spouse and unmarried children under 21. That makes EB‑5 especially compelling for parents who want to create options for more than one family member through a single immigration strategy.
The identity of the principal investor should be considered carefully. Depending on the child’s age, education plans, source of funds and family objectives, a parent or adult child may be the better applicant.
Greater freedom in education and employment
Permanent residents are not dependent on an F‑1 student visa, an H‑1B lottery or one sponsoring employer. They can generally live, study and work anywhere in the United States, subject to the ordinary rules applicable to permanent residents.
This flexibility can materially expand internship, graduate employment and career opportunities. It can also reduce the uncertainty students face when their ability to remain in the United States depends on changing visa rules or employer sponsorship.
Timing matters before a child turns 21
Children normally must remain unmarried and under 21 to immigrate as derivatives. The Child Status Protection Act may freeze or adjust age calculations in some circumstances, but it does not eliminate every age-out risk.
Families with teenagers or university-age children should obtain advice early. Source-of-funds work, project selection and petition preparation require time, and visa availability can affect the steps needed to preserve eligibility.
